When buying a vehicle from a dealer you enter into a contract governed mainly by the Sale of Goods Act, 1979. The Sale and Supply of Goods to Consumers Regulations, 2002 and Sale & Supply of Goods Act, 1994 also give certain rights to the buyer.

Those Acts state that each car sold by a dealer must be of satisfactory quality, fit for purpose and as described.

To be considered of satisfactory quality the car must be as good as a reasonable person expects, bearing in mind the price paid and how the dealer describes the car. This level of quality includes the safety, durability and appearance of the vehicle. What you can expect depends on the mileage of the car, how much you paid for it and its age.

If a new car has even the tiniest defect it is not considered to be of satisfactory quality.

To be fit for purpose the vehicle should be capable of doing what you would expect for a car of its price, size and type. It should also do what the dealer promised.

A car that is as described is a one that corresponds in every detail to the advert you saw for it. For a second-hand car, the mileage has to be genuine; anything you are told about its history has to be 100% true. A new car must be unused and flawless.

If the car you have brought does not live up to the above standards, you have the right to complain to the dealer. They should compensate you or give you a refund. It is best to make you complaint in writing, clearly stating what the issues are. Most dealers are very good at resolving issues once they are made aware of them. In the event that you do not manage to solve the problem amicably, you can contact your local Trading Standards Office.
